TreStack Bundles terms and conditions

The agreement for TreStack Bundles: using the app, plans and usage charges billed through Shopify, what you may not do, and how either side ends the arrangement.

These terms and conditions are an agreement between you and TreStack. They cover TreStack Bundles, from the first install. By installing the app, you agree to be bound by them. If you do not agree, do not install the app. Your use of trestack.app itself is covered by the main terms and conditions at trestack.app/terms.

If you install on behalf of a client, you confirm you are authorised to accept these terms for that store. TreStack Bundles is distributed through the Shopify App Store.

These words carry the same meaning wherever they appear in this document.

TreStack, we, us
The studio that publishes TreStack Bundles, at 40 Nguyen Huu Tho, Hoa Cuong, Da Nang, Vietnam. TreStack is an early-stage startup and is not yet a registered company.
The app
TreStack Bundles, including its admin inside Shopify, its theme app extension, its discount and cart functions, its web pixel, and the services behind them at bndl.trestack.app.
Merchant, you
The person or company operating the Shopify store on which the app is installed, and anyone installing on that store with authority to do so.
Shopper
A visitor to your storefront or a customer of your store. Shoppers are not party to this agreement; their relationship is with you.
Deal
An offer you build in the app, such as quantity breaks, a bundle, buy X get Y, or mix and match, with its discounts, texts, translations, styles, and images.
Content
Anything you write into the app or upload through it: deal texts, translations, custom styles, and images.
Added revenue
For each group of order lines a shopper buys through a deal that carries the deal's own discount, what the group brings in above the single item price of its main product, summed over your orders and converted to United States dollars at the European Central Bank reference rate of each order's day.

You must be at least eighteen years old, or acting as an authorised representative of a business, and you must have authority to bind the store on which you install.

Subject to these terms and to payment of the applicable fees, we grant you a limited, non exclusive, non transferable, revocable licence to use the app on the store it is installed on, for the purpose of operating that store. You may use it on any store you operate or administer, including client stores, with a separate plan per store. Nothing in that licence transfers ownership of anything.

You are responsible for the content you put into the app and for what your deals tell shoppers, including that every price, saving, and offer they show is true, and that each deal's discounts are the ones you intend to give.

The app has no separate account. You sign in through your Shopify admin, so access to the app follows your Shopify credentials and the staff permissions you grant on your store. Keep those credentials confidential and give staff access only to people you trust.

Tell us promptly if you believe the app has been used on your store without authorisation. The information we keep about your store is described in the Bundles privacy policy.

The plans, their prices, and the monthly added revenue each one covers are listed on the app's Shopify App Store listing and on the Plans page inside the app, which are the current list. Charges are made through Shopify's billing and appear on your Shopify invoice, so we never hold your card details. Prices are in United States dollars, and taxes are handled by Shopify as part of its billing.

A 14 day free trial applies to a store's first paid subscription. Subscribing again or reinstalling does not start a new trial: you get only the days left of the first one. After the trial ends, the subscription renews each billing period, monthly or yearly, until you cancel it in the app or uninstall the app. Building and publishing deals needs a plan, trial included, except on development stores.

Monthly plans
Each plan covers an amount of added revenue per 30 day billing period. If a period's added revenue goes past it, the app charges the difference in price to the plan that covers it, as a usage charge on your Shopify invoice, and only up to the usage limit you approved in Shopify. Your plan itself does not change, and the next period starts again from the plan you chose. Added revenue during the trial is never counted.
Annual plans
Annual plans have no usage line. After each 30 day period ends, added revenue above the plan's limit is charged per started 100 dollars at the rate shown for that plan, as a one time charge you approve in Shopify. An amount under the minimum Shopify accepts is carried to the next period.
Unpaid charges
If an annual overage charge is not approved within 7 days, your deals stop showing on your storefront until it is approved. The app admin stays open, and nothing you built is deleted.
Cancelling
When you cancel in the app, your deals are unpublished and their discounts removed from your store. Uninstalling the app does the same.
Development stores
Shopify Partner development stores are billed in test mode, so they are never charged.
Price changes
A price change will be announced inside the app before it applies and will not take effect inside a period you have already paid for.
Refunds
If the app did not do what its listing says it does, write to us and we will look at a refund for the current period.

You may not do any of the following with the app.

  • Resell, sublicense, or rebrand the app as your own product
  • Copy the app's storefront markup, styles, script, or functions into a theme or another app to avoid a plan
  • Reverse engineer or decompile the app, except where that restriction is void under the law that applies to you
  • Use a deal to show a price, saving, or offer that is false to shoppers
  • Put content into a deal that you have no right to publish
  • Attempt to bypass billing, plan limits, usage charges, or the Shopify permission model
  • Send pixel events, alter the app's line properties, or automate access in ways the app does not make on its own
  • Pretend to be TreStack, or suggest we endorse something we do not
  • Use the app to break the law or to infringe anyone else's rights
  • Probe, overload, or attack the app, other than a good faith security test you report to us

We own the app, the TreStack name and marks, the deal templates and presets, and the documentation. The licence above is permission to use the app, not a transfer of any of that. You may say factually that your store runs TreStack Bundles, but not in a way that suggests we built or operate your store.

You own your content. You grant us only the permission needed to store, process, and display it so the app can do its job, for as long as the app is installed. The same applies to anything you send us by email or as feedback in the app: we use it to answer you and to improve the app, and we do not publish it or attribute it to you without asking first. We do not use your content to train models.

If you send us feedback or a feature suggestion, we may act on it without owing you anything for it.

The app runs on Shopify and depends on it: its discounts and cart changes run as Shopify Functions, and its billing is Shopify's. Your use of Shopify is governed by your agreement with Shopify, not by this one, and an outage, policy change, or API change on their side can affect what the app can do. Shopify also limits how many automatic discounts a store can have active at once, across all of its apps. We do not control that and do not accept liability for it.

Your theme and the other apps on your store decide much of how a deal looks and behaves on your storefront. How they interact with the app is outside our control, though we will help where we can.

The app names other services, such as Shopify. Those names belong to their owners, mentioning them does not mean they endorse us, and their own terms cover what they do.

We may change the app, and we may change or withdraw features. A withdrawal that removes something you depend on will be announced inside the app rather than shipped quietly.

We may change these terms. A material change will be dated above and announced inside the app before it takes effect, and continuing to use the app after that date accepts the change.

You may end the agreement at any time by uninstalling. Because nothing is written into your theme files, uninstalling removes the app embed and blocks with it, and the app's discounts stop applying. What happens to your data on uninstall is set out in the Bundles privacy policy.

We may suspend or end the service for a store that breaches the section on prohibited conduct, that does not pay, or where continuing would put shoppers at risk, and we will tell you why.

The sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive the end of the agreement.

The app is provided as described in its listing and documentation, and otherwise as is and as available. To the extent the law allows, we disclaim the implied warranties, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the app will be uninterrupted or error free, that it will raise your sales or order value, or that it will suit a purpose we have not described. We aim to keep the app available whenever Shopify is, but we do not offer a contractual uptime figure.

The app's analytics are estimates built from Shopify's order data and from the pixel events of shoppers who allowed analytics. They are not accounting records, and billing reads only the added revenue defined above.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profit, lost sales, lost data, or loss of goodwill. We cannot control your traffic, your theme, your prices, or the other apps on your store, and you are responsible for checking the discounts your deals give.

Our total liability for any claim is limited to the fees you paid us for the app in the twelve months before the claim.

We do not limit liability for fraud, for death or personal injury caused by negligence, or for anything else the law does not let us limit. Nothing here removes a right you hold as a consumer under mandatory law.

You will indemnify TreStack against third party claims, losses, and reasonable legal costs arising from your use of the app in breach of these terms, from content you put into the app, or from what you offer shoppers with it. We will tell you promptly about any such claim, let you control its defence, and not settle it without asking you.

This agreement is governed by the laws of Vietnam, and disputes go to the competent courts of Vietnam. Nothing here takes away a consumer protection right that the law of your own country gives you and does not allow to be waived.

Before either side files anything, write to us and give us thirty days to sort it out.

These terms, the Bundles privacy policy, and the Bundles data processing agreement are the whole agreement between us on this subject and replace anything said before.

  • If a provision is held invalid, the rest stays in force and the invalid part is read as narrowly as needed to make it valid
  • Not enforcing a right on one occasion does not waive it
  • You may not assign this agreement without our consent. We may assign it to a successor of the business, and will say so here if that happens
  • Notices to you go to the contact email on your Shopify store or appear inside the app. Notices to us go to the address below
  • Neither side is liable for a failure caused by something genuinely outside its control
  • Nothing here makes either side the agent, partner, or employer of the other
