Acceptance of terms
These terms and conditions are an agreement between you and TreStack. They cover TreStack Timer, from the first install, and this website at trestack.app. By installing the app or using the site, you agree to be bound by them. If you do not agree, do not install the app and do not use the site.
If you install on behalf of a client, you confirm you are authorised to accept these terms for that store. TreStack Timer is listed on the Shopify App Store.
Definitions
These words carry the same meaning wherever they appear in this document.
- TreStack, we, us
- The studio that publishes TreStack Timer, at 40 Nguyen Huu Tho, Hoa Cuong, Da Nang, Vietnam. The registered entity name is to be confirmed.
- The app
- TreStack Timer, including its admin inside Shopify, its theme app extension, the email timer images, and the services behind them at timer.trestack.app.
- The site
- trestack.app and everything published on it: the product pages, guides, blog, and documentation.
- The services
- The app and the site together.
- Merchant, you
- The person or company operating the Shopify store on which the app is installed, anyone installing on that store with authority to do so, and anyone using the site.
- Shopper
- A visitor to your storefront or a recipient of your emails. Shoppers are not party to this agreement; their relationship is with you.
- Content
- Anything you write into the app or upload through it: timer text, translations, links, schedules, and background images.
- View
- One timer seen by one visitor in a browser session on your storefront, counted per store per calendar month across all your timers.
Use of the services
You must be at least eighteen years old, or acting as an authorised representative of a business, and you must have authority to bind the store on which you install.
Subject to these terms and to payment of the applicable fees, we grant you a limited, non exclusive, non transferable, revocable licence to use the app on the store it is installed on, for the purpose of operating that store. You may use it on any store you operate or administer, including client stores, with a separate plan per store. Nothing in that licence transfers ownership of anything.
The site is free to read and has no accounts, forms, or gated content. You may use it for any lawful purpose that does not get in the way of anyone else using it.
You are responsible for the content you put into the app and for what your timers tell shoppers, including that every deadline and offer they show is true.
Account registration and security
The app has no separate account. You sign in through your Shopify admin, so access to the app follows your Shopify credentials and the staff permissions you grant on your store. Keep those credentials confidential and give staff access only to people you trust.
Tell us promptly if you believe the app has been used on your store without authorisation. The information we keep about your store is described in the privacy policy.
Payment, billing, and refunds
The plans, their prices, and their monthly views are listed on the pricing page at trestack.app/pricing, which is the current list. Charges are made through Shopify's billing and appear on your Shopify invoice, so we never hold your card details. Prices are in United States dollars, and taxes are handled by Shopify as part of its billing.
A 7 day free trial applies to a store's first paid subscription. After it ends, the subscription renews each billing period, monthly or yearly, until you cancel by moving to the Free plan or uninstalling the app.
- Creating and publishing
- Any plan can create and edit every timer type. The plan only matters when you publish a timer.
- Near your limit
- At 80 percent of your monthly views the app shows a warning.
- At your limit
- Your timers stop showing on your storefront until the next month in your store timezone or an upgrade, and then come back by themselves because they stay published. Until then, new timers cannot be published and published ones cannot be edited. Email timers are not affected.
- Downgrading
- Before you move to a lower plan, the app lists the timers that plan does not cover. Those timers are unpublished when the downgrade takes effect.
- Development stores
- Shopify Partner development stores are billed in test mode, so they are never charged.
- Price changes
- A price change will be dated in the changelog before it applies and will not take effect inside a period you have already paid for.
- Refunds
- If the app did not do what this site says it does, write to us and we will look at a refund for the current period.
Prohibited conduct
You may not do any of the following with the app or the site.
- Resell, sublicense, or rebrand the app as your own product
- Copy the timer markup, styles, or script into a theme to avoid a plan
- Reverse engineer or decompile the app, except where that restriction is void under the law that applies to you
- Use a timer to show a deadline or an offer that is false to shoppers
- Put content into a timer that you have no right to publish
- Attempt to bypass billing, plan limits, or the Shopify permission model
- Send count events, request email timer images, or automate access in ways the app does not make on its own
- Copy the site in bulk with automated tools, or republish it as your own
- Pretend to be TreStack, or suggest we endorse something we do not
- Use the services to break the law or to infringe anyone else's rights
- Probe, overload, or attack the services, other than a good faith security test you report to us
Intellectual property
We own the app, the site, the TreStack name and marks, the colour presets, and the documentation. The licence above is permission to use the app, not a transfer of any of that. You may say factually that your store runs TreStack Timer, but not in a way that suggests we built or operate your store.
You may link to any page of the site, quote short passages with a link back, and print or save guides for your own store's use. Anything beyond that needs our written permission.
You own your content. You grant us only the permission needed to store, process, and display it so the app can do its job, for as long as the app is installed. The same applies to anything you send us by email or live chat: we use it to answer you and to improve the services, and we do not publish it or attribute it to you without asking first. We do not use your content to train models.
If you send us feedback or a feature suggestion, we may act on it without owing you anything for it.
Third party services and links
The app runs on Shopify and depends on it. Your use of Shopify is governed by your agreement with Shopify, not by this one, and an outage, policy change, or API change on their side can affect what the app can do. We do not control that and do not accept liability for it.
Email timers are shown by whatever email tool you paste the snippet into. How that tool and each recipient's email client display images is outside our control.
The site links to and names other services, such as Shopify and the tools mentioned in the guides. Those names belong to their owners, mentioning them does not mean they endorse us, and their own terms cover what they do.
Modifications to the services and terms
We may change the services, and we may change or withdraw features. A withdrawal that removes something you depend on will be noted in the changelog rather than shipped quietly.
We may change these terms. A material change will be dated above and noted in the changelog before it takes effect, and continuing to use the services after that date accepts the change.
Termination
You may end the agreement at any time by uninstalling. Because nothing is written into your theme files, uninstalling removes the app embed and blocks with it. What happens to your data on uninstall is set out in the privacy policy.
We may suspend or end the service for a store that breaches the section on prohibited conduct, that does not pay, or where continuing would put shoppers at risk, and we will tell you why.
The sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive the end of the agreement.
Disclaimers
The app is provided as described on the site, and otherwise as is and as available. To the extent the law allows, we disclaim the implied warranties, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the services will be uninterrupted or error free, or that the app will suit a purpose we have not described. We aim to keep the app available whenever Shopify is, but we do not offer a contractual uptime figure.
The guides, blog posts, and docs describe how things worked when they were written, on the themes and plans they name. Shopify, themes, and apps change, so a step may no longer match what you see. They are general information, not legal, financial, or professional advice for your particular store. Test a change on a copy of your theme before you publish it.

Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profit, lost sales, lost data, or loss of goodwill. We cannot control your traffic, your theme, or the other apps on your store.
Our total liability for any claim is limited to the fees you paid us for the app in the twelve months before the claim. The site is free, and we are not liable for any loss that comes from relying on what it says.
We do not limit liability for fraud, for death or personal injury caused by negligence, or for anything else the law does not let us limit. Nothing here removes a right you hold as a consumer under mandatory law.
Indemnification
You will indemnify TreStack against third party claims, losses, and reasonable legal costs arising from your use of the services in breach of these terms, from content you put into the app, or from what you tell shoppers with it. We will tell you promptly about any such claim, let you control its defence, and not settle it without asking you.
Governing law and dispute resolution
This agreement is governed by the laws of Vietnam, and disputes go to the competent courts of Vietnam. Nothing here takes away a consumer protection right that the law of your own country gives you and does not allow to be waived.
Before either side files anything, write to us and give us thirty days to sort it out.
Miscellaneous
These terms, the privacy policy, and the data processing agreement are the whole agreement between us on this subject and replace anything said before.
- If a provision is held invalid, the rest stays in force and the invalid part is read as narrowly as needed to make it valid
- Not enforcing a right on one occasion does not waive it
- You may not assign this agreement without our consent. We may assign it to a successor of the business, and will say so here if that happens
- Notices to you go to the contact email on your Shopify store or to the changelog. Notices to us go to the address below
- Neither side is liable for a failure caused by something genuinely outside its control
- Nothing here makes either side the agent, partner, or employer of the other
