TreStack Checkout terms and conditions

The agreement for TreStack Checkout: using the app, plans billed through Shopify, Shopify Plus, what you may not do, and how either side ends the arrangement.

These terms and conditions are an agreement between you and TreStack. They cover TreStack Checkout, from the first install. By installing the app, you agree to be bound by them. If you do not agree, do not install the app. Your use of trestack.app itself is covered by the main terms and conditions at trestack.app/terms.

If you install on behalf of a client, you confirm you are authorised to accept these terms for that store. TreStack Checkout is coming to the Shopify App Store and will be distributed through it.

These words carry the same meaning wherever they appear in this document.

TreStack, we, us
The studio that publishes TreStack Checkout, at 40 Nguyen Huu Tho, Hoa Cuong, Da Nang, Vietnam. TreStack is an early-stage startup and is not yet a registered company.
The app
TreStack Checkout, including its admin inside Shopify, its checkout and post-purchase extensions, its Shopify Functions, its web pixel, and the services behind them at cplus.trestack.app.
Merchant, you
The person or company operating the Shopify store on which the app is installed, and anyone installing on that store with authority to do so.
Buyer
A person going through checkout, or viewing the thank you or order status page, on your store. Buyers are not party to this agreement; their relationship is with you.
Configuration
What you set up in the app: block profiles, upsells, gifts, post-purchase offers, surveys, payment and shipping customizations, order validations, cart links, branding, and translations.
Content
Anything you write into the app or upload through it: block texts, offer and survey texts, rule messages, translations, and images.

You must be at least eighteen years old, or acting as an authorised representative of a business, and you must have authority to bind the store on which you install.

Subject to these terms and to payment of the applicable fees, we grant you a limited, non exclusive, non transferable, revocable licence to use the app on the store it is installed on, for the purpose of operating that store. You may use it on any store you operate or administer, including client stores, with a separate plan per store. Nothing in that licence transfers ownership of anything.

You are responsible for the content you put into the app and for what your checkout tells buyers, including that every price, discount, offer, and message is true, that the rules you set hide, rename, or block only what you intend, and that what your surveys ask is lawful to ask.

The app has no separate account. You sign in through your Shopify admin, so access to the app follows your Shopify credentials and the staff permissions you grant on your store. Keep those credentials confidential and give staff access only to people you trust.

Tell us promptly if you believe the app has been used on your store without authorisation. The information we keep about your store is described in the Checkout privacy policy.

The plans, their prices, and what each includes are listed at trestack.app/checkout/pricing and on the Plans page inside the app, which are the current list. Charges are made through Shopify's billing and appear on your Shopify invoice, so we never hold your card details. Prices are in United States dollars, and taxes are handled by Shopify as part of its billing.

A 14 day free trial applies to a store's first paid subscription. Subscribing again or reinstalling does not start a new trial: you get only what is left of the first one. After the trial ends, the subscription renews each billing period, monthly or yearly, until you cancel it in the app or uninstall the app.

Shopify Plus
The Growth and Pro plans need a store on Shopify Plus, because Shopify allows apps on the checkout page itself only for Shopify Plus stores. A store not on Shopify Plus can choose Starter. What Shopify allows on each of its plans is decided by Shopify, not by us.
Cancelling
When you cancel in the app, your configuration is kept, and the app stops running on your checkout: blocks, rules, upsells, and gifts are paused until you choose a plan again. There is no prorated refund for the rest of the period.
Development stores
Shopify development stores use the app for free, with every feature.
Discount codes
A code entered on the Plans page reduces your subscription as the code describes.
Price changes
A price change will be announced inside the app before it applies and will not take effect inside a period you have already paid for.
Refunds
If the app did not do what its pricing page and documentation say it does, write to us and we will look at a refund for the current period.

You may not do any of the following with the app.

  • Resell, sublicense, or rebrand the app as your own product
  • Copy the app's extensions, functions, or pixel into another app to avoid a plan
  • Reverse engineer or decompile the app, except where that restriction is void under the law that applies to you
  • Use a block, offer, or rule to show buyers a price, discount, or message that is false
  • Use a survey to collect information you have no lawful basis to collect, or sensitive personal data
  • Put content into the app that you have no right to publish
  • Attempt to bypass billing, plan limits, or the Shopify permission model
  • Send pixel events, call the app's checkout endpoints, or automate access in ways the app does not make on its own
  • Pretend to be TreStack, or suggest we endorse something we do not
  • Use the app to break the law or to infringe anyone else's rights
  • Probe, overload, or attack the app, other than a good faith security test you report to us

We own the app, the TreStack name and marks, the block templates, and the documentation. The licence above is permission to use the app, not a transfer of any of that. You may say factually that your store runs TreStack Checkout, but not in a way that suggests we built or operate your store.

You own your content. You grant us only the permission needed to store, process, and display it so the app can do its job, for as long as the app is installed. The same applies to anything you send us by email, by live chat, or as feedback in the app: we use it to answer you and to improve the app, and we do not publish it or attribute it to you without asking first. We do not use your content to train models.

If you send us feedback or a feature suggestion, we may act on it without owing you anything for it.

The app runs on Shopify and depends on it: its blocks are Shopify checkout extensions, its rules and validations run as Shopify Functions, its branding is saved through Shopify's checkout settings, and its billing is Shopify's. Your use of Shopify is governed by your agreement with Shopify, not by this one, and an outage, policy change, or API change on their side can affect what the app can do, including where blocks may appear and which Shopify plans may use them. We do not control that and do not accept liability for it.

The review stars the app shows come from the product ratings your reviews app saves in Shopify. That app, and the other apps on your store, are outside our control, though we will help where we can.

The app names other services, such as Shopify, Judge.me, and Okendo. Those names belong to their owners, mentioning them does not mean they endorse us, and their own terms cover what they do.

We may change the app, and we may change or withdraw features. A withdrawal that removes something you depend on will be announced inside the app rather than shipped quietly.

We may change these terms. A material change will be dated above and announced inside the app before it takes effect, and continuing to use the app after that date accepts the change.

You may end the agreement at any time by uninstalling. Because nothing is added to your theme, uninstalling stops the app's blocks, rules, and offers at once. What happens to your data on uninstall is set out in the Checkout privacy policy: Shopify asks us to delete it 48 hours later.

We may suspend or end the service for a store that breaches the section on prohibited conduct, that does not pay, or where continuing would put buyers at risk, and we will tell you why.

The sections on intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive the end of the agreement.

The app is provided as described on trestack.app and in its documentation, and otherwise as is and as available. To the extent the law allows, we disclaim the implied warranties, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the app will be uninterrupted or error free, that it will raise your sales or order value, or that it will suit a purpose we have not described. We aim to keep the app available whenever Shopify is, but we do not offer a contractual uptime figure.

The app's analytics are estimates built from the pixel events of buyers who allowed analytics, the offers buyers accepted, and your orders. They are not accounting records.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profit, lost sales, lost data, or loss of goodwill. We cannot control your traffic, your prices, Shopify's checkout, or the other apps on your store, and you are responsible for checking the rules, discounts, and messages your configuration gives buyers.

Our total liability for any claim is limited to the fees you paid us for the app in the twelve months before the claim.

We do not limit liability for fraud, for death or personal injury caused by negligence, or for anything else the law does not let us limit. Nothing here removes a right you hold as a consumer under mandatory law.

You will indemnify TreStack against third party claims, losses, and reasonable legal costs arising from your use of the app in breach of these terms, from content you put into the app, or from what you show or ask buyers with it. We will tell you promptly about any such claim, let you control its defence, and not settle it without asking you.

This agreement is governed by the laws of Vietnam, and disputes go to the competent courts of Vietnam. Nothing here takes away a consumer protection right that the law of your own country gives you and does not allow to be waived.

Before either side files anything, write to us and give us thirty days to sort it out.

These terms, the Checkout privacy policy, and the Checkout data processing agreement are the whole agreement between us on this subject and replace anything said before.

  • If a provision is held invalid, the rest stays in force and the invalid part is read as narrowly as needed to make it valid
  • Not enforcing a right on one occasion does not waive it
  • You may not assign this agreement without our consent. We may assign it to a successor of the business, and will say so here if that happens
  • Notices to you go to the contact email on your Shopify store or appear inside the app. Notices to us go to the address below
  • Neither side is liable for a failure caused by something genuinely outside its control
  • Nothing here makes either side the agent, partner, or employer of the other
